These Terms of Service ("Terms") govern your access to and use of the Lesson Plan HQ platform, including our website at lessonplanhq.com and any related applications, features, or services (collectively, the "Service"), operated by Jeva Technologies OPC ("Company", "we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service. Where local consumer protection laws in your jurisdiction provide rights that cannot be waived by contract, those rights are not affected by these Terms.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. Teachers, school administrators, and educational institution representatives who use the Service on behalf of minors are solely responsible for ensuring appropriate consent and safeguards are in place under applicable local law. The Service is not intended for direct use by students under the age of 13 (or the applicable minimum age in your jurisdiction).

2. Account Registration

To access certain features, you must create an account. You agree to:

Provide accurate, current, and complete registration information.
Keep your credentials confidential and not share them with others.
Notify us immediately at support@lessonplanhq.com of any unauthorized use of your account.
Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that appear to have been compromised.

3. Description of Service

Lesson Plan HQ is an AI-powered platform that helps K–12 educators generate lesson plans, visual aids, quizzes, and related teaching materials. Key features include:

AI lesson plan generation across multiple curriculum frameworks, including but not limited to 5E, UbD, and other US K–12 models; MOE- and SLS-aligned structures (Singapore); Kurikulum Merdeka and K13 RPP (Indonesia); and other supported templates.
AI-generated visual aids and instructional graphics.
Automated quiz creation with multiple question formats.
Live online quiz hosting for students via shareable links, with exam, teacher-paced, and auto-paced modes.
PDF export of generated materials.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

4. AI-Generated Content

The Service uses artificial intelligence to generate educational content. By using AI generation features, you acknowledge and agree that:

AI-generated content is produced automatically and may contain errors, inaccuracies, or outdated information. You are responsible for reviewing, verifying, and editing all generated content before use in a classroom or educational setting.
Generated content should not be treated as professional, pedagogical, or legal advice.
The Company does not guarantee that AI-generated materials will be curriculum-compliant, free of bias, or appropriate for every audience. You exercise your professional judgment in their use.
Your prompts and inputs may be processed by third-party AI providers. Do not enter personally identifiable information about students or other individuals into AI generation prompts.
Outputs may sometimes be similar to content generated for other users. The Company makes no warranty of uniqueness.

5. Acceptable Use

You agree not to use the Service to:

Generate, distribute, or store content that is illegal, harmful, abusive, harassing, defamatory, obscene, or discriminatory.
Create or share content that violates the intellectual property rights of others.
Impersonate any person or entity or falsely represent your affiliation.
Reverse engineer, decompile, or attempt to extract the source code or underlying AI models of the Service.
Scrape, crawl, or otherwise harvest data from the Service without our written consent.
Use the Service for commercial resale or redistribution without prior written permission.
Attempt to gain unauthorized access to any part of the Service or its infrastructure.
Introduce viruses, malware, or other harmful code.

We may monitor use of the Service and remove content or suspend accounts that we reasonably believe violate these standards.

6. Intellectual Property

Our Content

All technology, software, design, branding, trademarks, and proprietary content underlying the Service are owned by or licensed to Jeva Technologies OPC. You may not copy, modify, or distribute them without our written consent.

Your Content and Inputs

You retain ownership of the prompts, custom templates, and other materials you submit. By submitting content, you grant us a limited, non-exclusive, royalty-free license to process that content solely to provide and improve the Service.

Generated Outputs

Subject to these Terms and applicable law, you are granted a non-exclusive right to use AI-generated outputs for your personal or professional educational purposes. You may not resell or sublicense generated outputs as standalone products.

7. Subscriptions and Payments

Certain features of the Service require a paid subscription. By subscribing:

You agree to pay all applicable fees as described on our pricing page at the time of purchase. Fees are displayed in USD unless otherwise indicated at checkout.
Subscriptions automatically renew unless cancelled before the renewal date.
All fees are non-refundable except where required by applicable law or as expressly stated in our Refund Policy below.
We reserve the right to change pricing with at least 30 days' advance notice to active subscribers.
Payments are processed by our third-party payment provider, Paddle.com Market Limited ("Paddle"), who acts as Merchant of Record. Your purchase is subject to Paddle's terms and conditions in addition to these Terms.

If you believe you have been charged in error, contact us within 30 days at support@lessonplanhq.com.

8. Refund Policy

All subscription purchases are non-refundable. You may cancel your subscription at any time and you will retain access to your plan until the end of your current billing period.

Exception for annual plans: If you are on an annual plan, cancel within 14 days of your initial purchase, and have used fewer than 20 Premium Credits, you may request a pro-rata refund by contacting support@lessonplanhq.com. This exception does not apply to renewals.

Where applicable consumer protection laws in your jurisdiction require a different refund policy, those statutory rights are not excluded by these Terms.

9. Privacy

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully to understand how we collect, use, and protect your information. Our Privacy Policy describes how we comply with applicable data protection laws across our operating jurisdictions.

10. Student Data and Education Privacy

If you use the Service in connection with students, you represent that you have obtained all necessary consents and authorizations required under applicable education and data privacy laws in your jurisdiction before submitting any student-related information. This includes but is not limited to:

FERPA and COPPA (United States)
Personal Data Protection Act, PDPA (Singapore)
Data Privacy Act of 2012 / Republic Act No. 10173 (Philippines)
Undang-Undang Perlindungan Data Pribadi / UU PDP (Indonesia)
Any other applicable national or regional data protection legislation

Do not input personally identifiable student data into AI generation prompts. The Service is designed as a teacher-facing tool; students interact only through anonymous quiz sessions via shareable links.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR COMPLETE.

Some jurisdictions do not allow the exclusion of implied warranties. In those jurisdictions, the above exclusions apply only to the extent permitted by applicable law.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JEVA TECHNOLOGIES OPC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR ANY HARM RESULTING FROM RELIANCE ON AI-GENERATED CONTENT.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

13. Indemnification

You agree to indemnify, defend, and hold harmless Jeva Technologies OPC and its affiliates, officers, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

14. Third-Party Services

The Service integrates with or links to third-party platforms including AI model providers, payment processors (Paddle), and authentication services. We are not responsible for the content, practices, or availability of those third-party services. Your use of them is subject to their respective terms and privacy policies.

15. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access immediately if you breach these Terms or if we discontinue the Service. Upon termination, your right to use the Service ceases and we may delete your account data in accordance with our data retention practices described in the Privacy Policy.

Upon expiration or cancellation of your subscription, the following applies immediately: AI generation of lesson plans, visual aids, and quizzes is suspended; hosting of new live quiz sessions is disabled. Any live quiz session already in progress at the time of expiration will not be interrupted and will complete normally. Only new sessions initiated after expiration are restricted.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Singapore, without regard to its conflict of law provisions. We chose Singapore as a neutral and internationally recognized jurisdiction appropriate for a globally operating service.

Any dispute arising from or relating to these Terms shall first be attempted to be resolved through good-faith negotiation between the parties. If unresolved within 30 days, disputes shall be submitted to the non-exclusive jurisdiction of the courts of Singapore.

Nothing in this clause limits any mandatory rights you may have under the consumer protection laws of your country of residence.
